I have a friend who has a hacked Wii, and has never encountered difficulty. I cannot speak to what Nintendo actually does, but think of it this way: In all likelihood, they would just ask you to remove the "illegal" bits and restore it to its prior state. Threatened with the choice of a fine or undoing the hack, you'd just undo the hack, right? *shrug*

I don't think they do anything beyond what Eric said to the people with the hacked products. The real legal ramifications would probably fall on anyone who makes a tidy business out of hacking Wiis for other owners.

I find it hard to think they'd fine you because they don't have the authority to do that. At worst I think they'd ban you from online stuff. But then wouldn't you be able to download the things and move it onto the Wii anyway?
